RCN Communications LLC, doing business as (“d/b/a”) RCN Technologies, and its subsidiaries and affiliates (“RCN Technologies,” “we,” “us,” or “our”) provide information and services on our website(s) (the “Site”) and through the EdgeVUU customer portal (the “Portal”) under the following terms and conditions. By accessing, browsing, or using the Site or Portal in any manner, you acknowledge that you have read, understood, and agree to be bound by these terms and conditions. If you do not agree, you must immediately discontinue use.

1. Compliance with Laws and Regulations

Access to and use of the Site and Portal are subject to all applicable international, federal, state, and local laws and regulations. You agree not to use the Site or Portal in any way that violates such laws or regulations.

2. Copyrights and Trademarks

All information available on or through the Site and Portal — including text, images, graphics, logos, and software — is the property of RCN Technologies or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not modify, copy, distribute, transmit, display, publish, sell, license, create derivative works from, or otherwise use any information for commercial or public purposes without prior written permission. Limited personal, non-commercial use with proper attribution is permitted, provided it does not infringe intellectual property rights or misrepresent affiliation with RCN Technologies. You may not use our marks, logos, or service marks (including as hotlinks or metatags) without prior written permission.

3. Prohibited Actions & Tampering

You agree not to:

• Modify, add to, delete, or otherwise tamper with content;
• Decompile, reverse-engineer, disassemble, or attempt to access underlying code or proprietary information;
• Engage in hacking, data scraping, or unauthorized access to restricted areas;
• Interfere with security features or attempt to bypass authentication measures;
• Use automated systems (bots, crawlers, or scripts) to extract data.

Any violation may result in suspension of access and legal action.

4. Third-Party Content and Disclaimer

The Site or Portal may contain information provided by independent third parties. RCN Technologies does not control or guarantee the accuracy, reliability, or completeness of such content, and you assume full responsibility for your reliance on it.

5. Links to Third-Party Websites

The Site or Portal may include links to third-party websites for convenience. RCN Technologies does not endorse or control these sites and assumes no responsibility for their content, security, privacy practices, or the quality of any products or services offered. You access them at your own risk.

6. Links from Third-Party Websites

Unauthorized linking to the Site or framing of its content is prohibited. RCN Technologies may disable any unauthorized links or frames and assumes no responsibility for third-party sites linking to ours.

7. Disclaimer of Warranties

All information and documents on the Site and Portal are provided “as is” without any express or implied warranties, including merchantability, fitness for a particular purpose, or non-infringement. We make reasonable efforts to keep content accurate and current but do not guarantee accuracy or completeness and may update content without notice. You assume full responsibility for the risks of use. Availability of the Portal is not guaranteed; the substantive service levels for your underlying services are governed by your MSA or applicable order forms.

8. Customer Portal & Online Services

This section governs use of the EdgeVUU customer portal.

• Authorized users only. Access to the Portal is limited to users authorized by your organization. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
• What the Portal provides. The Portal gives visibility into your services, network assets and sites, invoices, and support. It is an informational and account-management tool.
• Your underlying services control. Your services remain governed by your Master Service Agreement and any applicable order forms and Statements of Work; those documents control in the event of a conflict with these Terms of Use.
• Emergencies. For any urgent, service-affecting issue, contact our Network Operations Center directly rather than relying solely on a Portal support ticket.
• Suspension. We may suspend or restrict Portal access for non-payment, suspected unauthorized use, or violation of these Terms.

9. Returns and Refunds

If you wish to return a product, please review our Return Policy for eligibility, timeframes, and procedures.

10. Invoicing & Payment Terms

Payment is due as stated on the applicable invoice. Overdue balances are subject to late charges, administrative fees, and collection and legal costs as set forth in the applicable invoice, our Terms of Purchase, or your MSA, and RCN Technologies may suspend or terminate services or Portal access for non-payment.

11. Modifications to Terms of Use

RCN Technologies may update or change these Terms of Use at any time without prior notice. Continued use of the Site or Portal after modifications constitutes acceptance of the updated terms.

12. Governing Law

These Terms of Use are governed by the laws of the State of Tennessee, without regard to conflicts-of-law principles. Any dispute relating to purchases or services is subject to the dispute-resolution, arbitration, and class-action-waiver provisions of the Terms of Purchase and/or your MSA, which control.
